1. Collection and Use

Humaniz, Inc. (“Humaniz” or “us” or “we” or “our”) collects and uses Personal Information from or about you to help us provide the best services to our users. This Privacy Policy governs the manner in which we collect, use, and maintain information collected from subscribers, applicants, visitors and users (collectively, “you” or “your”) of our Platform, as well as any derivative or affiliated websites on which this Privacy Policy is posted, linked, or referenced. Our Platform is owned and operated by Humaniz, its affiliates, subsidiaries and parent companies.

Information that we collect on our Platform and from our Services is stored in the United States and is subject to U.S. law.

Children’s Privacy

You must be 18 years of age or older to visit or use our Platform or Services in any manner. The Site, Platform and the Services are not directed to anyone under the age of 13. We do not knowingly collect or solicit information from anyone under the age of 13, or allow anyone under the age of 13 to sign up for the Service. In the event that we learn that we have gathered personal information from anyone under the age of 13 without the consent of a parent or guardian, we will delete that information as soon as possible. We reserve the right to modify this Privacy Policy at any time, with or without notice to you, the user, in which case the revised Privacy Policy will appear on the Platform. You should visit this URL periodically to review the most current Privacy Policy because this Privacy Policy is binding on you in connection with your use or access of our Platform, Site or Services. This Privacy Policy constitute a binding agreement between Humaniz and you, and is deemed accepted by you each time that you use or access our Platform or our Services, as amended from time to time.

2. Definitions

Service Providers means those parties that provide services on Humaniz’s behalf. This includes entities that help us to deliver our Services to you, including, but not limited to, our web servers and site databases, data storage, analytics, applicant management tools, payment processing services, job copy creation services, and customer service.

Third Parties as Required by Law means entities that must receive information because of a legal obligation. This includes government agencies and law enforcement pursuant to a lawful request.

All other capitalized terms that are not defined in this Privacy Policy shall have the same definition as set forth in our Terms.

3. Information We Collect, Process, Use and Store

While using our Platform, we may ask you to provide us with certain personally identifiable information that may be used to (a) operate our Platform and Services, (b)  contact, communicate or identify you in connection with our Platform and Services, (c) collect and share applicant resumes or CVs with our subscribers, (d) connect applicants to subscribers, (e) analyze, improve and optimize our Platform, Site and Services, (f) ensure compliance with and enforce our Terms of Use, this Privacy Policy, our Service Agreement and Ad Management Rider by all users, (g) protect our users against fraud and abuse, (h) provide users with newsletters, marketing or promotional materials and to offer Users other Services and/or information related to our affiliate and partner entities and organizations, (i) provide SMS messages or email alerts in connection with the Services, (j) provide support and customer service in connection with the Services, (k) to defend our legal rights, and (l) to comply with applicable law. Personally identifiable information may include, but is not limited to, your name, address, telephone number, email address, ID/passport, driver’s license, academic and professional qualifications, CV/resume, transcripts and employment references, work history, cover letters, education level, professional licenses, compensation/benefits requests, relocation information, login credentials, permissions, and any other information you provide to us in support of and during the application or interview process, links to social media profiles (i.e., LinkedIn, Meta, etc.), feedback and satisfaction data, your availability and responses to calendar invitations for interviews, information concerning work availability such as immigration status, work authorizations, visas, business information, contact details, employer identification number or tax identification number, IP address, ISP, browser type and device ID, operating system, date/timestamp, location, geolocation, clickstream data, feedback and testimonials, your activity on our Platform, Site or Services including which URLs are accessed, viewed, and the duration of your activity (collectively, the “Personal Information”).  Subscribers may be required to provide additional Personal Information from time to time to allow us to provide the Services.

Humaniz collects this Personal Information in the following ways:

– when you use our Platform, Services, Site, software and applications, we collect information that your browser sends (“Log Data”) to us. This Log Data may include information such as your computer’s Internet Protocol (“IP”) address, browser type, browser version, the pages of our Platform that you visit, the time and date of your visit, the time spent on those pages, and other statistics;
– when you create an account as a subscriber;
– when you contact customer support;
– when applicants respond to a subscriber’s job listing or advertisement;
– we may use third party services, such as Google Analytics, to collect, monitor and analyze Log Data;
– we receive and store information when you enter it on our Platform, send it to us, upload it using our Services, apply to a job listing or advertisement, or provide it to us in any other way;
– automatically when you visit our Platform; and
– if you are located in the United States, we may collect information about you from publicly available websites or third-party providers.

Humaniz may perform automated processing of your Personal Information to analyze and predict your preferences and interests. In some circumstances, automated processing is necessary for us to provide our Services to share applicant Personal Information to our subscribers, and subscriber Personal Information to our applicants. For example, automated processing allows us to match applicants with subscribers more effectively, to provide applicants with alerts and recommended jobs, to send applications to subscribers, to allow subscribers to search for applicants through our Services, and to perform certain spam and fraud detection activities to protect our users. Humaniz does not make decisions based solely on automated processing.

Retention of Personal Information

Humaniz will retain your Personal Information in accordance with our internal data retention policies, after which time it may be automatically deleted from our systems unless we are legally required to keep it for a longer timeframe. As of the Effective Date, Humaniz does not delete any user information, however, this is subject to change. When such change becomes effective, we will update this Privacy Policy. Users should not rely on Humaniz’s Platform to store any data associated with our Servies or Platform. Users should regularly backup their data to ensure that no data is lost as a result of any suspension, termination or disruption of the provision of our Services.

Resume Visibility

Information that you provide through our Site, Services and Platform to subscribers may be accessed, used, shared, and stored by said subscriber, even if such access, use, sharing or storage is contrary to the Terms, this Privacy Policy or the Service Agreement. We cannot control these third parties and we are not responsible for their access, use, sharing or storage of your Personal Information.

We cannot control the retention, use or privacy of resumes that have been viewed or downloaded by others. Once your resume has been downloaded by a third party, we are not able to retrieve it from the third parties who accessed it. Accordingly, you should not put sensitive information, personality profiles, or other information you would not want made public in your resume or profile. If an application you submitted through our Platform includes the Personal Information of a reference, such as their name, email, phone number or address, it is your responsibility to ensure that the person is aware that you have forwarded their details and that such person has consented for you to make such information public.

Users release Humaniz, and its directors, officers, employees, contractors and representatives from any and all liability, claims, damages, costs, and causes of action resulting from a subscriber or any other user’s retention, storage, access or use of an applicant’s Personal Information in connection an applicant’s response to a job listing or advertisement, and each user shall indemnify, defend and hold Humaniz, and its directors, officers, employees, contractors and representatives harmless from any and all liability, claims, damages, costs, and causes of action associated with a third party obtaining a user’s Personal Information, or the Personal Information of a user’s personal references.

Sale of Personal Information

We reserve the right to sell, trade, rent or otherwise share your Personal Information with third parties to provide you with products or services that we believe may be of interest to you. By using our Services or our Platform, you consent to the sale of your Personal Information for these purposes.

We may also share Personal Information with outside parties if we have a good-faith belief that access, use, preservation or disclosure of the information is reasonably necessary to meet any applicable legal process or enforceable governmental request; to enforce applicable Terms of Service, including investigation of potential violations; address fraud, security or technical concerns; or to protect against harm to the rights, property, or safety of our users or the public as required or permitted by law.

No mobile information will be sold or shared with third parties for promotional or marketing purposes.

Law Enforcement

Your Personal Information may be shared with Third Parties as Required by Law to protect the rights or property of Humaniz, to investigate fraud, prevent crime, protect national security, and to protect the personal safety of our users or the public. Humaniz will take reasonable steps to share the minimum information necessary to comply with requests by law enforcement or governmental authorities. In some cases, we may have a legal obligation to collect or retain Personal Information or may need the Personal Information to protect your vital interests or those of another person. In certain circumstances, we may ask for your consent (separately from any agreement between us) before we collect, use, or disclose your personal data.

Information Shared with Service Providers

We may share and process your Personal Information to perform services in connection with our Platform and our Services, to improve the Platform and our Services, products, and features, to protect our users and to optimize our Platform and our users’ experience with our Platform. By using our Platform or our Services, you acknowledge and agree to our use of such third-party Service Providers for the purpose of collecting, processing, analyzing, and recording your activity on, interaction with, and communications with, or through our Platform. Such activities include, but are not limited to, tracking which areas of our Platform you visit (including URLs), which content you view, which information you input, where you click, scroll, hover, or otherwise interact through the Platform, and the time you spend on our Platform and for each activity. Our Service Providers collect this data from everyone using the Platform.

Humaniz’s use and transfer of information received from Google APIs to any other app will adhere to Google API Services User Data Policy, including the Limited Use requirements.

As of the Effective Date of this Privacy Policy, Humaniz integrates the tools, services and software from the following companies into our Site and Platform to provide the best Services for our users including, but not limited to, Heap (https://heap.io) for traffic and data analytics, Twilio (https://www.twilio.com/en-us) for customer engagement, Honeybadger (https://www.honeybadger.io/) for bug reporting, Betterstack (https://betterstack.com/) for logs and log management, Webflow (https://webflow.com/?r=0) for marketing, and AWS (https://aws.amazon.com/?nc2=h_lg) and Heroku (https://www.heroku.com/home) for hosting. Please make sure to review the privacy policies for each of these websites to understand how the Personal Information you provide may be processed, stored and used by such companies.

4. Cookie Policy

We may use cookies on our Platform, which are small text files that are placed on your computer, phone, tablet, mobile device or any other device used to access our Site or Platform by a web server. 6. Mergers and Acquisitions

Personal Information collected by us pursuant to this Privacy Policy, may be disclosed to one or more third parties in connection with any change of ownership or control in Humaniz’s business (whether by merger, acquisition, sale, or otherwise), or any other reorganization or joint venture, or assignment, transfer or other disposition of all or any portion of our business, assets or stock, and any such information may be used by such third party in accordance with this Privacy Policy until you are otherwise notified.

7. Security

The security of your Personal Information is important to us. We utilize a variety of safeguards including best in class cloud infrastructure and data encryption to protect your Personal Information submitted to us, both during transmission and once it is received, however, as stated above, no data transmission or storage is completely secure. Your submission, upload or transmission of any Personal Information to our Platform is done at your own risk.

While Humaniz takes measures to safeguard any Personal Information that you share with us from unauthorized access or inappropriate use, no method of data transmission over the internet can be completely secure.

Users are responsible for keeping their username and password secret at all times and not sharing such information with third parties.

Humaniz may update this Privacy Policy to reflect updates in our information practices.
